AWARE AT THE SCENE: Wait for emergency responders in a safe location away from incoming traffic.
CALL THE POLICE: Insist that they file a report and explain how the accident occurred to the officer. Mention anything negative the other party said such as, "I was coming from a bar" or "I just checked my phone for a second".
GATHER INFORMATION: Make sure to get essential information from the other driver including drivers license, insurance information, and license plate. Do not take "I don't have insurance or a license" for an answer! If the other party says this, wait for the police to confirm and place it in the police report.
SAVE YOUR APOLOGIES: A simple “I’m sorry” can be taken as an admission of you being at-fault. But you should still be kind and courteous to insure all involved are okay.
WRITE DOWN INFORMATION REGARDING ALL WITNESSES’: Obtain full contact information. This includes name, address, telephone & email.
TAKE PHOTOGRAPHS: Take detailed photographs of all of the vehicles, the scene, and anything of importance. The more photos the better. Make sure that the pictures are taken from far enough away to show everything that happened.
SEEK MEDICAL TREATMENT IMMEDIATELY: This is an absolute must, make sure to take care of yourself! You and your passengers are the most important people to be worried about. Get the medical treatment you need.
